Client Rights

HIPAA provides you with certain rights, including several new or expanded rights with regard to your Case Record and disclosures of Protected Health Information (PHI):

  1. You may make a written request to examine or obtain a copy of your Billing or Case Record, as noted above.
  2. You may request that I amend your Billing or Case Record, or that I include information you have requested to be placed in your record. You may also provide written information you wish entered into your record. Please be aware that anything you provide for your Clinical Record may be released without your consent as noted in the Exceptions to Confidentiality above.
  3. You may request restrictions on what information from your Billing or Clinical Records is disclosed to others, with the exceptions noted in Exceptions to Confidentiality noted above.
  4. You may request an accounting of most disclosures of protected health information that you have neither consented to nor authorized.
  5. You may request information about the locations to which protected information disclosures were sent.
  6. You may have any complaint(s) about my policies and procedures recorded in your records.
  7. You have a right to a paper copy of this signed Disclosure Statement, Notice of Privacy Practices and Agreement for Counseling Services.
  8. You have the right to register a complaint with the U.S. Department of Health and Human Services if you believe your rights, as explained above, have been violated. They may be contacted by writing a letter to 200 Independence Ave., S.W., Washington, D.C. 20201, calling 1 (877)696-6775 or online at www.hhs.gov/ocr/privacy/hipaa/complaints. I will not retaliate against you if you file a complaint about my privacy practices.

How I Can Be Contacted

Due to my work schedule, I am not often immediately available to talk by phone. To schedule, change or cancel appointments it is easiest to reach me on my cell phone by texting me at (413) 663-0094.

Confidential messages may be left on my email. Once you have started counseling, I recommend contacting me by email at douglas.s.duncan6@gmail.com to schedule or change appointments. If you are difficult to reach and want to talk, please let me know of several times you may be available. Please note that messages left on my email are not HIPAA compliant because they do not fully protect your PHI. Only leave messages that do not contain sensitive personal health information (PHI).

You may try to reach me after hours for emergencies. Because I may not be available, please remember that if you believe you have a medical emergency, or may be at risk of harming yourself or someone else, you should call 911 or go to your nearest hospital emergency room for immediate help. If you are not at risk and can wait, please leave a text on my cell phone and I will get back to you as soon as I can. Make sure you identify yourself by name. If I am away for an extended time, such as on vacation, I will leave the name and number of a colleague who is also a Biblical counselor to contact.

On-line sessions are available through Simple Practice and you will be given a portal through which you will be sent links for accessing upcoming sessions.
